A 12-year-old boy charged with raping a six-year-old girl at their Sydney northern beaches primary school has been granted permission to miss a court date to go on a family holiday to Queensland.
In court yesterday the boy’s barrister, James Viney, entered not guilty pleas to six charges on his behalf, reports News Limited.
The lawyer also asked the court if the boy’s bail conditions could change so he could go interstate on a family trip and be excused from his November 24 court date. Magistrate Louise McMahon agreed.
The ABC reports that court documents allege that the boy and his co-accused, a boy also aged 12, indecently assaulted the young girl three times while together during incidents between June and July in the school toilets.
The boy is also accused of raping the alleged victim twice on his own between June 24 and July 1, and on August 16.
The girl reportedly told someone at school about the attacks and authorities were notified and the pair was arrested and charged on August 30.
The boy is charged with four counts of indecent assault, three while in company, and two counts of sexual intercourse with a child under 10.
The boy’s co-accused is on bail and will face Hornsby Local Court next month on similar charges.
