It was just after 7am when Margaret Hill entered a Coles store with her son in western Sydney reports SMH.
She was perusing the fruit and vegetable section in the Kings Langely store, before she passed a refrigerated cabinet and her things slipped in opposite directions reports SMH.
Ms Hill remembers is “doing the splits” and ending up on the floor.
“I just remember being flung off my feet and seeing my keys and wallet go flying across the room and then I’ve just hit the ground with a thud,” Ms Hill said.
Ms Hill suffered a significant injury to her left ankle, which required surgery and left her incapacitated for several weeks.
The NSW court district has awarded her $292,335 in damages stating:
“The plaintiff was an active woman prior to the accident, and has suffered a severe injury to her left ankle,” Judge Phillip Mahony said.
“This has affected her mobility and her ability to carry out all of her domestic, recreational, social and even some of her working tasks,” he said.
“It has had a severe impact on her life’s activities and her ability to enjoy those activities.”
