Thurman, 44, and millionaire Basson, 51, ended their two-year engagement in April, which was the second time the pair had called it quits since they began dating in 2007.

The custody spat is reportedly over unresolved visitation issues which have been increasingly difficult to settle because of Busson’s European based business and Thurman’s choice to set up residence in Manhattan.

The Kill Bill actress, who has two other children, Maya 16, and Levon, 12, is said to be unable to relocate her life because the father of her eldest children, actor Ethan Hawke, lives in New York City also.

“It is unfortunate that this very private discussion regarding Mr. Busson’s visitation rights and his participation in decision making has been made public,” a spokesperson for Thurman told PEOPLE in a statement.

“However, we are optimistic that a fair agreement for both sides will be reached out of court.”

Court documents indicate the custody case was assigned to matrimonial court Tuesday and records will be sealed.

Busson, who is rumoured to be now dating The English Patient star Kristen Scott Thomas, has two sons – Flynn, 16, and Cy, 11, from a former relationship with Aussie supermodel Elle Macpherson.

Meanwhile rumours that Thurman has been dating quirky director Quentin Tarantino were denied.
