The Modern Family star and her businessman ex are currently embroiled in a heated legal battle after Nick filed a lawsuit against Sofia in 2015 so he could bring to term the couple’s two female embryos.
However, the latest development to surface sees the actress, 44, winning the fight to have 41-year-old Nick reveal the name of two of his ex-partners who allegedly had abortions 20 years ago.
Despite Nick appealing the decision, the judge’s response was final as the court want to further investigate his sexual past.
Exclusively speaking to Page Six, Nick said he’s prefer to be locked up behind bars than ’fess up the names of his exes.
“I would rather go to jail than reveal the names,” he said. “I believe we have to protect a woman’s right to privacy.”
Unluckily for Nick, he doesn’t have a choice.
The once-loved-up duo are now fighting it out in court.
Sofia and Nick were engaged for two years before the actress broke it off in May 2014.
In an op-ed he penned for The New York Times back in April last year, Nick wrote that he and Sofia had agreed to try to use vitro fertilisation and a surrogate to have a child in 2013. They signed an agreement that any successfully made embryos would be brought to term if both parties consented.
Under Californian law, Loeb is now trying to have this agreement scrapped.
“Many have asked me: Why not just move on and have a family of your own? I have every intention of doing so,” he wrote.
“But that doesn’t mean I should let the two lives I have already created be destroyed or sit in a freezer until the end of time.”
Since breaking her engagement off with Nick in 2014, Sofia has been married to True Blood’s Joe Manganiello for almost 12 months.
Sofia was named 2015’s highest paid actress in 2015.
Despite this, Sofia, who is already a mum-of-one, wants the embryos destroyed.
“A child needs a mother and a loving relationship with parents who don’t hate each other,” she says.
“I wouldn’t want to bring kids to the world where it’s already set against them. It would be so selfish.”
