Reese Witherspoon and her husband Jim Toth were arrested and briefly jailed last weekend after being pulled over for suspicion of DUI.
The pair were driving through Atlanta, Georgia, on Friday morning when they were stopped by police, People magazine reports.
Jim, 42, was charged with DUI after driving in the wrong lane, while Reese, 37, was handcuffed and arrested for disorderly conduct after disobeying instructions from the arresting officer to stay inside the vehicle.
The police report states that Jim was seen weaving across a double line. When they stopped him, he had watery, bloodshot eyes and smelled of alcohol, which prompted the officer to administer a breath test. He returned a reading of .139, well above the US limit of .08.
Reese became agitated at this point and “began to hang out the window and say that she did not believe that I was a real police officer”, the report states.
Reese then exited the car and was instructed to get back in, but refused. She resisted the officer as her husband tried to calm her down.
The officer claims in his report that, “Mrs Witherspoon asked, ‘Do you know my name?’ I answered, ‘No, I don’t need to know your name.’ I then added, ‘right now’. Mrs. Witherspoon stated, ‘You’re about to find out who I am.’ “
The two were released on bond at 3.30am Friday and a court date is pending.
Witherspoon’s rep did not respond to requests for comment.
