“I’m not going through anything,” Sofia told US presenter Howard Stern in an interview on his SiriusXM radio show.
“He’s going through it,” she said.
The Modern Family actress, 42, is currently embroiled in a dispute with ex-fiancé Nick, 39, who has filed a lawsuit to prevent the destruction of two cryopreserved female embryos, according to court documents obtained by In Touch Weekly.
In 2013, Nick and Sofia went through several rounds of IVF in an attempt to conceive a child and the two embryos he is seeking to preserve are made up of Sofia’s eggs, fertilised with his sperm.
Nick has been so vociferous about the cause, he even penned an op-ed for The New York Times entitled “Our Frozen Embryos Have a Right to Live.”
“A child needs a mother and a loving relationship with parents who don’t hate each other,” Sofia, who is now engaged to actor Joe Manganiello explained.
“I don’t hate him but obviously he has a problem. A kid needs parents. I wouldn’t want to bring kids to the world where it’s already set against them. It would be so selfish.”
In his op-ed, which Sofia denied reading, Nick wrote: “Many have asked me: Why not just move on and have a family of your own? I have every intention of doing so. But that doesn’t mean I should let the two lives I have already created be destroyed or sit in a freezer until the end of time.”
Sofia had a more pragmatic approach. “You sign papers,” she said of their agreement.
She continued: “If it was so serious for him, this issue, which I totally respect because it’s serious. Then you should’ve taken it more seriously at the time. There is a contract. He can’t do anything…. We did it two times. You make the mistake the first time. Two times? And now you want to change your mind?! … You have to follow what you sign!”
The documents, which were filed under the pseudonyms of John and Jane Doe, states that Nick “seeks to ensure that the Female Embryos are not destroyed, but Jane Doe [Sofia] refuses to agree to their preservation under all circumstances.”
As to how Sofia is coping with the pressure of the lawsuit and the intense media scrutiny surrounding the case? She insists that she’s calm.
“I’m okay,” she told Howard Stern. “I didn’t do anything wrong.”
She also noted: “This is a year later.”
As to how she and her new fiancé Joe,were dealing with the case?
“Joe and I try not to even talk about it,” the mother-of-one said.
“We have lawyers. We’re having so much fun right now. We just moved into a new house. We’re planning a wedding. We try not to think about this, we can’t do anything. It’s signed, it’s done, and that’s it.”
